Terms of Service

1. Service Description

KAP Selekto LTD, a company registered in the Republic of Cyprus under registration number HE 495743 ("Selekto"), provides a software-as-a-service (SaaS) platform that enables real estate professionals to create curated property selections, share them with clients, and track client engagement. The service is accessible via the selekto.net website.

2. Accounts

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Upload false, misleading, or fraudulent property information
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or its infrastructure
• Scrape, crawl, or use automated means to access the service without permission
• Share your account credentials with third parties

4. Property Data

Property listings displayed on the platform may be sourced from third-party providers. Selekto does not guarantee the accuracy, completeness, or availability of any property listing. Brokers are responsible for the accuracy of property information they import and share.

5. AI-Assisted Features & Photo Enhancement

5.1 Nature of the Features

The platform offers optional AI-assisted tools, including tools that adjust the visual presentation of property photographs (such as exposure, colour balance, sharpness, and resolution) and tools that generate or improve listing text. Some photo tools may use generative techniques. Images processed by these tools are marked as AI-enhanced by a visible label and/or embedded metadata. You must not remove, obscure, or circumvent such markings. Where you export or republish AI-enhanced images outside the platform, you are responsible for preserving any disclosure required by applicable law, including Regulation (EU) 2024/1689 (the EU AI Act).

5.2 Intended and Prohibited Use

AI photo tools are provided solely to improve the presentation quality of photographs. They are not designed to, and must not be used to, conceal, remove, repair, or otherwise misrepresent the physical condition or material characteristics of a property — including, without limitation, structural defects, cracks, damp or mould, the state of repair, dimensions and layout, permanently installed fixtures, or views from the property, or any other feature that could influence a client's transactional decision. Automated processing cannot reliably distinguish cosmetic imperfections from material defects; the tools do not verify, and are not capable of verifying, that an output image remains a truthful representation of the property.

5.3 Your Responsibility

You remain solely and fully responsible for all content you publish or share through the platform, including AI-enhanced photographs and AI-generated text. Before publishing any enhanced image, you must review it and confirm that it faithfully corresponds to the actual, current condition of the property. Publishing an enhanced image constitutes your own editorial decision and your representation that the image is not false or misleading. You are responsible for ensuring that your listings comply with all laws applicable to your activity, including Cyprus consumer protection legislation and Directive 2005/29/EC on unfair commercial practices, and with any rules of third-party marketplaces to which you export content.

5.4 Disclaimer and Indemnity

AI-assisted features are provided "as is". Selekto does not review, approve, or verify individual outputs, and does not warrant that any output is accurate, complete, or a faithful representation of a property. To the maximum extent permitted by law, Selekto disclaims all liability arising from your use or publication of AI-enhanced or AI-generated content, including any claim based on a discrepancy between published images and the actual property. You agree to indemnify and hold Selekto harmless from any third-party claims, damages, or regulatory penalties arising from content you published or shared, including AI-enhanced content. Original photographs may be retained by the platform for a limited period to enable reverting an enhancement; reverting is your sole remedy for an unsatisfactory output.

6. Subscription Plans & Billing

Selekto offers multiple paid subscription tiers (Agent, Double Agent, Elite Agent, Enterprise) with varying limits on properties, clients, and team members. Plan details and pricing are displayed on the Subscription page within the platform.

6.1 Free Trial

New broker accounts may receive a free trial of the Double Agent plan. During the trial you have full access to Double Agent features. No payment information is required to start a trial. The trial duration is displayed during registration and on your Subscription page. When the trial expires without a paid subscription, your account moves to the limited state described in Section 6.5.

6.2 Paid Subscriptions

Paid plans are billed monthly in EUR. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel at any time from your Subscription page — your plan remains active until the end of the current billing period.

6.3 Refunds

Selekto does not offer prorated refunds for partial billing periods. If you cancel your subscription, you retain access to paid features until the end of the current billing cycle. For billing disputes or errors, contact us at support@selekto.net.

6.4 Plan Changes

Selekto reserves the right to modify plan pricing and features with 30 days advance notice to affected subscribers. Existing subscribers retain their current pricing for the remainder of their billing cycle.

6.5 Limited State Without an Active Subscription

If your trial expires or a paid subscription ends, your account is not closed and your data is not deleted. Your properties, clients and selections are preserved and remain accessible to you. Core functions continue to work, including editing your existing listings and creating and sharing selections. Functions reserved for paid plans — including creating new listings beyond the limits applicable to your account, marketplace feed exports, and AI-assisted features — become unavailable until you subscribe again. We may apply storage or retention limits to inactive accounts, in which case we will notify you in advance by email.

7. Intellectual Property

The Selekto platform, including its design, features, and content (excluding user-uploaded data), is owned by Selekto and protected by applicable intellectual property laws. You retain ownership of data you upload to the platform.

8. Limitation of Liability

To the maximum extent permitted by law, Selekto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the service. Our total liability shall not exceed the amount paid by you for the service in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the service at any time for violation of these terms. You may terminate your account at any time from your account settings or by contacting us. If you have an active paid subscription, cancellation takes effect at the end of the current billing period as described in Section 6. Upon termination, your right to use the service ceases, though we may retain certain data as required by law.

10. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
